  • The Oregon Court of Appeals decision is rather straight forward. Mr. Wirkala told the police he wanted an attorney and they continued to question him. Mr. Wirkala was obviously intoxicated, and a bit hostile . I wonder if keep the transcript/film of Luke being hostile will result in a different outcome. The real issue is the jury instructions on self defense and the forensic work up.

    This is an absolutely disgraceful ruling. Our judicial system MUST be reevaluated. An innocent man is servo g life in prison for self defense??

    The whole thing is dumbfounding you have to ask yourself if Luke would have been a female would the police have actually arrested him or helped him? I’ve known him since I was 5 years old we grew up together and I can tell you fist hand he is a good man that deserves to be able to go home to his family not sit in prison for the rest of his life. They need to release him now..
